თბილისის მერიის ყოფილი თანამშრომელი ოთარ აბესაძე, რომელი ქრთამის აღების ბრალდებით არის დაკავებული, სასამართლომ პატიმრობაში დატოვა.

 

 

არ დაკმაყოფილდა დაცვის მხარის შუამდგომლობა აღკვეთის ღონისძიების შეცვლის თაობაზე - დაცვის მხარე ოთარ აბესაძისთვის შეფარდებული აღკვეთის ღონისძიების პატიმრობის 50 000-ლარიანი გირაოთი შეცვლას ითხოვდა. 

 

 

ბრალდებულის ადვოკატი სასამართლოს გადაწყვეტილების დაუსაბუთებლობაზე საუბრობს.

 

 

„არც ერთ არგუმენტი არ იყო დასაბუთებული, ძალიან სამწუხაროა, რომ სასამართლომ ასეთ ტიპის გადაწვეტილება მიიღო, მაშინ როდესაც სასამართლო თავად ადგენს სტანდარტებს და საქართველოს კონსტიტუცია ცალსახად განმარტავს, რომ არ შეიძლება, აღკვეთის ღონისძიების სახით გამოყენებულ პატიმრობას ჰქონდეს სადამსჯელო ხასიათი. ის არის პრევენციული ხასიათის მხოლოდ და მხოლოდ იმისთვის, რომ ბრალდებული არ მიიმალოს და გამოცხადდეს სასამართლოში," განაცხადა ირმა ჭკადუამ. 

 

 

საქმის პროკურორის განცხადებით, არ დასრულებულა საქმეზე მოწმეთა დაკითხვის პროცესი და არსებობს საშიშროება იმისა, რომ ბრალდებულმა მათზე ზეგავლენა მოახდინოს.

 

 

„მოსამართლემ გაიზიარა ბრალდების მხარის პოზიცია და ძალაში დატოვა ოთარ აბესაძისთვის შეფარდებული აღვეთის ღინისძიება პატიმრობა, ვინაიდან სასამართლო პროცესზე დასაკითხია მოწმეები, რომელთა უმრავლესობასთან ბრალდებულს აკავშირებს ნაცნობობა. გარდა ამისა, სხვა საკითხებიც უნდა ყოფილიყო განხილული, თუმცა ვერ განვიხილეთ, ვინაიდან დაცვის მხარემ დააყენა შუამდგომლობა პროცესის გადადებასთან დაკავშირებით,“ განაცხადა პროკურორმა.
